Seat Trade Terms of Use

1. Acceptance of Terms

By using Seat Trade, you confirm that you have read, understood and agree to be bound by these Terms and all applicable laws. If you do not agree, you must discontinue use of the App immediately.

2. Eligibility

You may use Seat Trade only if you are at least the age of majority in your jurisdiction or have the consent and supervision of a parent or legal guardian. By using the App, you represent and warrant that you meet these requirements and that you are legally capable of entering into a binding agreement.

3. Account, authentication and security

• Seat Trade uses phone number–based authentication (via Firebase Authentication). You agree to provide a valid phone number and to complete the verification process.
• You are responsible for maintaining the confidentiality of your account and for all activities that occur under your account.
• You must notify us promptly if you become aware of any unauthorized access or use of your account.
• We reserve the right to suspend or terminate your access to the App if we believe your account has been compromised or used in violation of these Terms.

4. Use of the App

Seat Trade provides tools to help you:

• Check PNR status and view journey details.
• Create and manage seat exchange offers within your coach.
• Send and receive seat exchange requests.
• Communicate with other passengers using in-app chat features.

You agree to use the App only for lawful purposes and in accordance with these Terms. You are solely responsible for how you interact with other users and for any decisions you make based on information displayed in the App.

5. Seat exchange and responsibilities

Seat Trade only facilitates discovery and coordination of potential seat exchanges between passengers. It does not guarantee that any seat exchange is permitted by railway authorities or that other passengers will honor any agreement.

• Any decision to exchange seats is made directly between you and other passengers and is at your own risk.
• You must comply with all applicable rules and regulations of Indian Railways or any other relevant operator.
• Seat Trade and devhook are not responsible for disputes, disagreements, losses, delays, penalties, fines or any other consequences arising from seat exchanges.

6. PNR, train information and third‑party data

Seat Trade is not an official application of Indian Railways or any government entity. PNR status, train schedules and other journey details are obtained from third‑party APIs and data sources.

• We do not guarantee the accuracy, completeness or timeliness of any PNR or train-related information shown in the App.
• You should always verify critical travel information using official sources (such as IRCTC or railway enquiry counters).
• We are not liable for missed trains, wrong coach/berth information, delays or any loss resulting from reliance on data displayed in the App.

7. User conduct and prohibited activities

You agree not to use the App for any unlawful, harmful or abusive purpose. In particular, you must not:

• Harass, threaten, impersonate or abuse other users.
• Post or share content that is defamatory, obscene, hateful, discriminatory or otherwise objectionable.
• Attempt to hack, disrupt or interfere with the App, its servers or networks.
• Use automated scripts, bots or scraping tools to access or collect data from the App without our prior written consent.
• Reverse engineer, decompile or otherwise attempt to obtain the source code of the App, except as permitted by applicable law.
• Misuse the seat exchange or chat features for spam, advertising or any purpose unrelated to genuine travel coordination.

We may, at our discretion, suspend or terminate your access to the App if we believe you have violated these rules.

8. User content and license

Certain features of the App allow you to submit content such as offers, requests and chat messages (“User Content”). You remain responsible for your User Content and for ensuring that it complies with applicable laws and these Terms.

By submitting User Content, you grant devhook a non‑exclusive, worldwide, royalty‑free license to use, host, store, reproduce, modify and display such content as necessary to operate and improve the App and provide services to you and other users.

9. In‑app communications and notifications

Seat Trade may send you in‑app messages, push notifications or other communications about seat exchange requests, chat messages and important updates.

• You can control push notifications at any time through your device settings, although disabling them may impact your experience.
• You agree that we may send you service‑related communications that are necessary for the operation of the App.

10. Intellectual property

All intellectual property rights in and to the App (including but not limited to the design, interface, graphics, logos, trademarks, code and underlying technology) are owned by or licensed to devhook and are protected by applicable laws.

You are granted a limited, non‑exclusive, non‑transferable, revocable license to use the App solely for your personal, non‑ commercial use, in accordance with these Terms.

11. Disclaimers

The App is provided on an “as is” and “as available” basis, without warranties of any kind, whether express or implied. To the fullest extent permitted by law, devhook disclaims all warranties, including but not limited to:

• Warranties of merchantability, fitness for a particular purpose and non‑infringement.
• Any warranties regarding the accuracy, reliability or availability of PNR, train or seat data.
• Any warranties that the App will be uninterrupted, error‑free or secure.

Seat Trade is not affiliated with Indian Railways or any government body. Use of the App does not guarantee reservation, allocation or confirmation of seats or berths.

12. Limitation of liability

To the maximum extent permitted by law, devhook and its officers, directors, employees and partners shall not be liable for any indirect, incidental, special, consequential or punitive damages, or any loss of profits, revenues, data, goodwill or other intangible losses arising out of or in connection with:

• Your access to or use of, or inability to access or use, the App.
• Any conduct or content of other users or third parties.
• Any errors, inaccuracies or delays in PNR or train-related information.
• Seat exchanges, missed trains, penalties, disputes or other consequences of your travel decisions.

13. Indemnification

You agree to indemnify, defend and hold harmless devhook and its affiliates, officers, directors and employees from and against any claims, liabilities, damages, losses and expenses (including reasonable legal fees) arising out of or in any way related to:

• Your use or misuse of the App.
• Your violation of these Terms.
• Your violation of any rights of another person or entity.

14. Suspension and termination

We may suspend or terminate your access to the App at any time, with or without notice, if we reasonably believe that you have violated these Terms, engaged in fraudulent or abusive activity, or caused harm to other users or the platform.

Upon termination, your right to use the App will immediately cease. Certain provisions of these Terms that by their nature should survive termination (such as limitations of liability and indemnity) will continue to apply.

15. Changes to the App and to these Terms

We may update, modify or discontinue parts of the App at any time, temporarily or permanently, with or without notice. We may also update these Terms from time to time.

When we make material changes to the Terms, we will update the “Last updated” date at the top of this page and may provide additional notice within the App. Your continued use of the App after such changes constitutes your acceptance of the updated Terms.

16. Governing law and disputes

These Terms shall be governed by and construed in accordance with the laws of your applicable jurisdiction, without regard to its conflict of laws principles.

Any dispute arising out of or relating to these Terms or your use of the App shall, where permitted by law, be resolved in the courts of the jurisdiction in which devhook is established, unless otherwise required by mandatory local law.

17. General provisions

• If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect.
• Our failure to enforce any right or provision of these Terms shall not be deemed a waiver of such right or provision.
• These Terms constitute the entire agreement between you and devhook regarding your use of Seat Trade.
